Entain Faces Legal Action from Austrac Over AML and CTF Violations

Australia’s financial crime watchdog, Austrac, has initiated civil penalty proceedings against Entain for alleged breaches of anti-money laundering (AML) and counter-terrorism financing (CTF) laws. This is the first instance of Austrac pursuing legal action against an online betting operator in Australia. Entain, which operates brands such as Ladbrokes and Neds, has acknowledged the potential for significant financial penalties.

Key Allegations

Austrac’s investigation, launched in September 2022, uncovered extensive compliance failures within Entain’s operations, including:

  • Insufficient Oversight: The company’s board and senior management allegedly failed to implement adequate compliance controls, increasing exposure to criminal misuse.
  • Unverified Cash Transactions: Third parties were reportedly able to deposit funds into betting accounts without proper identity or source-of-funds verification.
  • Weaknesses with Higher-Risk Customers: Entain allegedly failed to carry out adequate checks on 17 high-risk individuals, heightening the risk of money laundering.
  • Use of Pseudonyms: Customers were allowed to use pseudonyms, obscuring their true identities.

Austrac also criticised Entain’s 24/7 online operations, citing increased risks of anonymous misuse of its platform.

Austrac’s Position

Austrac CEO Brendan Thomas highlighted the severity of the alleged violations, noting their implications for the broader community.

“We allege that Entain failed to develop and maintain a compliant anti-money laundering program, leaving it at serious risk of criminal exploitation,” said Thomas.

He further pointed out the societal impact of money laundering, often tied to crimes such as fraud and corruption.

Federal Court Proceedings

The Federal Court of Australia will determine whether Entain breached the AML/CTF Act and what penalties might apply. Entain has acknowledged the gravity of the claims, stating that it has cooperated with Austrac and is actively upgrading its AML and CTF systems, aiming for full implementation by mid-2025.

“We are committed to keeping financial crime out of gambling and supporting a compliant sector,” said Entain CEO Gavin Isaacs in a statement.

Industry-Wide Crackdown

Austrac’s action against Entain is part of an intensified regulatory focus on compliance within Australia’s gambling sector:

  • SkyCity Entertainment Group paid AU$67 million in penalties for breaches at its Adelaide casino.
  • Star Entertainment Group faces ongoing legal proceedings and risks losing state operating licences.
  • Crown Resorts was fined AU$450 million following investigations into AML failings at its Melbourne and Perth locations.

Austrac has also recently investigated other online betting platforms, including SportsBet and Bet365, with further remedial measures expected.

If found guilty, Entain could face substantial financial penalties, with past fines in the sector exceeding hundreds of millions of dollars. The case underscores Austrac’s commitment to ensuring AML and CTF compliance across both physical and digital gambling operations, sending a strong message to industry stakeholders.
